These Terms of Business govern all services provided by Beacon Project Consulting Ltd, trading as Beacon Building Consulting (“we”, “us”, or “our”) to clients and users of our website. By submitting a quote request or using our website, you confirm your agreement to these Terms, including the Website Disclaimer and Privacy Policy set out below.

2. Scope of Services

2.1) We provide a range of multi-disciplinary services, including but not limited to:

  • Civil, Structural, and MEP Engineering Design

  • Project Management and Planning Consultancy

  • Assigned Certifier and PSDP services

  • Property Inspection and Surveying

  • Technical Due Diligence

  • Regulatory and Building Control Compliance

2.2) Unless explicitly agreed otherwise in writing, all services are based on:

  • Visual, non-invasive inspections

  • Document-based reviews only when provided

  • Advice limited to the information available at the time of inspection or reporting

  • No destructive testing or concealed element investigation unless separately contracted

2.3) We are not responsible for verifying:

  • Building ownership

  • Title or legal boundary matters

  • Planning history or certification status (unless formally instructed)

  • The accuracy of client-supplied documents

 

2.4) Visual, Non-Destructive Scope of Inspections
All inspections provided as part of our services are visual and non-invasive unless otherwise expressly agreed in writing. We do not undertake destructive testing, lifting of finishes, opening up of concealed elements, removal of linings, or investigation of hidden elements unless this is separately contracted.

Conditions that are not visible or accessible at the time of the inspection (including sub-floor conditions, hidden services, concealed electrical elements, and other concealed components) are outside the scope of our inspection and no opinion is given on their condition. Any specialist testing (e.g. electrical, gas, plumbing, drainage, environmental assessment) is excluded unless specifically agreed in writing.

 

2.5) Excluded Specialist Inspections
Unless expressly stated in writing, Beacon Building Consulting does not provide specialist inspections, including but not limited to:
• electrical condition reports
• gas system assessments
• plumbing, drainage, or mechanical testing
• environmental or hazardous material surveys
• structural opening-up investigations

Clients must engage appropriately qualified specialists for such assessments.


 

3. General Limitations of Service

3.1) Where services include an inspection:

  • No opening-up of structure, lifting of linings, or exposure of hidden elements is undertaken

  • Unexposed or inaccessible elements are not assessed, and no opinion is given on their condition

  • Boundary positions are based on visual indicators only, not measurement or comparison to folio maps

  • Services installations are reviewed visually only; no testing or certification of electrical, mechanical, drainage or plumbing systems is carried out

  • We do not conduct tests or monitoring of environmental contaminants, gas, pyrite, asbestos, radon, PIR insulation shrinkage, or other risks unless separately agreed

  • Building Energy Rating (BER) certification is excluded unless expressly included in the engagement

3.2) While we use reasonable care in our inspections, due to the human nature of site reviews, some defects or conditions may be missed, or may not be visible at the time of the visit. No report can guarantee identification of all issues.

3.2) Reports & Subsequent Works: Where a written report is issued as part of an engagement, it reflects conditions observed at the time of inspection only, based on accessible and visible elements. We do not accept responsibility for conditions that only become apparent after renovation, demolition, remodeling, removal of finishes, alteration of structure, or other intrusive works which were not visible at the time of inspection.

No report, advice, summary, or documentation constitutes a guarantee that all existing conditions, defects, or issues will be identified. Some conditions may only manifest over time or with further exposure.

3.4) Any reports, opinions, or findings are based solely on conditions observed on the date of inspection. We do not accept liability for conditions that manifest after that date or which were concealed at the time of service.

3.5) Minor defects, cosmetic imperfections, or items of routine maintenance may not be included.


 

4. Assigned Certifier & PSDP Roles

Where we are appointed as Assigned Certifier or PSDP:

  • Our duties are strictly as outlined under the Building Control (Amendment) Regulations (BCAR) 2014

  • We act with reasonable skill and care in fulfilling inspection plans but do not guarantee full compliance by others

  • Responsibility for design, workmanship, and site compliance rests with the appropriate parties (builder, design team, contractors)

  • We do not provide collateral warranties unless explicitly agreed in advance


 

5. Client Obligations

The client is responsible for:

  • Ensuring safe and full access to sites and buildings

  • Supplying complete and accurate information and documentation

  • Highlighting any specific areas of concern in advance

  • Acting upon any recommendations made in reports

Failure to do so may limit the scope or accuracy of our advice, and we will not accept liability for omissions caused by restricted access, missing documents, or withheld information.


 

6. Intellectual Property

All reports, designs, drawings, and documents issued by us remain our intellectual property unless otherwise agreed. No report may be reproduced, distributed, or relied upon by third parties without our express written consent.


 

7. Liability and Indemnity

7.1) Our total liability in contract, tort (including negligence), or otherwise shall not exceed the fee paid for the relevant service unless otherwise required by law.

7.2) We are not liable for:

  • Indirect, special, or consequential loss

  • Economic loss, loss of profit, revenue, or opportunity

  • Loss or corruption of data or systems

  • Claims arising from third-party reliance on our services

7.3) All services are provided on behalf of the company, and no personal liability shall attach to any individual director, employee, or consultant involved in delivering the service.

7.4) Nothing in these terms limits liability for death or personal injury caused by our negligence, or other matters that cannot be excluded by law.


 

8. Payment Terms

  • Quotations are valid for 30 days unless otherwise stated

  • Invoices are due in full upon receipt or as otherwise agreed

  • We reserve the right to withhold delivery of reports or certificates where payment is outstanding

  • Interest may apply to overdue amounts under the Prompt Payment of Accounts Act


 

9. Dispute Resolution and Governing Law

9.1) These Terms shall be governed by Irish law.

9.2) Any dispute arising shall be subject to the exclusive jurisdiction of the courts of Ireland.


 

10. Complaints, Time Limits & Satisfaction Guarantee

a) Time for Notification
Any complaint, concern, or allegation relating to the services provided must be notified to Beacon Building Consulting in writing within 30 days of the date of the site visit, report delivery, or service completion, whichever is earlier. Failure to provide notice within this period shall be deemed acceptance that the service was performed with reasonable care and skill in accordance with the agreed scope of work.

b) Satisfaction Guarantee
Beacon Building Consulting aims to provide services with reasonable care and skill at all times. Where a written complaint is raised within the notification period above, and it can be demonstrated that services materially failed to meet the agreed scope of services, we will, at our discretion:
• provide reasonable clarification or additional explanation; or
• carry out a proportionate re-inspection of the relevant element; or
• apply a discretionary adjustment limited strictly to the part of the service affected.

This Satisfaction Guarantee does not constitute an unconditional right to a refund, does not modify any limitation of liability in these Terms, and does not apply to:
• issues outside the agreed scope of services;
• conditions that were not visible or accessible at the time of inspection;
• specialist disciplines not instructed in writing (e.g. electrical, gas, plumbing, environmental tests);
• matters only discovered after subsequent works, renovations, or opening-up works.
